□ Eligibility Criteria for Foreign Applicants 

A. Basic Requirements (Mandatory): Must satisfy all the following conditions (①~④)

① Currently registered foreigners who have resided for more than 4 years in the last 10 years with E-9, E-10, H-2 qualifications and are now actively working at their current place of employment. – At the time of application, they must be legally registered and working at their current workplace.
② A current employment contract with a salary of 26 million KRW or more for at least 2 years under the E-7-4 visa. – If converted to E-7-4 qualification, there should be an employment contract ensuring continued work at the workplace of application for at least 2 years. – If converted to E-7-4 qualification, the expected salary should be 26 million KRW or more in the employment contract (however, this is relaxed to 25 million KRW for those in agriculture/livestock, fisheries/domestic shipping).
③ Endorsed by a company where they have worked for more than 1 year.

<Employer Recommendation System>

○ (Overview) The foreigner in question is recommended by the CEO of the company where they have been working for more than 1 year (Attachment 5 – Recommendation Letter issued). → “Employer Recommendation” is a mandatory condition and an additional point item for the K-point E74 conversion.

○ (Recommendation Criteria) Can recommend up to 20% of the permanent workforce*. * Citizens listed in the employment insurance registry for more than 3 months with a minimum wage and foreign workers with valid work permits. ** Any decimal point in the allowable calculation is rounded up, and companies currently employing E-9 and E-10 foreign workers can recommend at least 1 person.

  • (Recommendation Limit Example) A business with 100 permanent workers can exercise up to 20 recommendation rights.

○ (Recommendation Limitation) If any wage default, assault, or other human rights violations occur after implementation, or if there’s illegal employment of foreigners, the company in question will immediately lose its recommendation rights and will be prohibited from recommending for the next 5 years.

④ Those who score at least 200 points, including additional points, out of a total of 300 points [with a minimum score of 50 points each for average income and Korean language proficiency]: Refer to the scoring chart. – The average annual income for the last 2 years* should be at least 25 million KRW*, and the Korean language proficiency should be at least TOPIK Level 2 or completed the 2nd level of the Social Integration Program or assigned the 3rd level (41 points) in the Social Integration Program Pre-evaluation.

* However, if it’s impossible to prove the income for the last 2 years due to reasons such as re-entry gaps, the income amount from the 2 highest earning years between ’18 and ’22 can be used. 

** Refers to the average of the total income from the last 2 years divided by 2. For those in agriculture/livestock or fisheries/domestic shipping, it’s relaxed to at least 24 million KRW.

B. Additional Points and Deductions

① (Additional Points) Consists of recommendations, long-term employment at the current workplace, and long-term work in areas with declining populations, and these additional points can be combined.
– (Recommendation) Recommendations are categorized into Central Government, Metropolitan Area Local Governments*, and Employer recommendations. Employer recommendation is a basic (mandatory) requirement, while Central Government and Metropolitan Area Local Governments’ recommendations are optional. If overlapping, only one is recognized. 
* Limited to the 17 Metropolitan Area Local Governments, and basic local governments recommend through the Metropolitan Area Local Governments. 

– (Current Workplace Tenure) Only applies to those who have continuously worked at their current workplace for more than 3 years as of the E-7-4 application date. 
– (Work Experience in Depopulated Areas) Refers to lawful and regular work experience of more than 3 years within the past 10 years in Korea under any of the three residency qualifications (E-9, E-10, H-2) in depopulated areas or townships. (Experience in depopulated areas and townships can be combined). 

– (Certification) If one possesses any domestic certification* among Engineer, Industrial Engineer, or Craftsman, it applies. * Domestic certification related to the field in which one is currently working as of the application date. 

– (Domestic University Degree) Applies to those who have studied at a domestic university and hold a degree of an associate or higher. – (Domestic Driver’s License) Only driver’s licenses issued by the domestic police of class 2 ordinary or higher are recognized. 

② (Deductions) Deductions are applied up to a maximum of 50 points (only cases within 10 years of the application date are considered). – (Fines of less than 1 million KRW) Up to a 20-point deduction depending on the number of times one has been fined less than 1 million KRW.
– (Those with a history of having residency limited due to tax arrears) Deductions of up to 15 points are applied depending on the number of times residency has been restricted due to tax arrears.
– (Those who have been administratively penalized for violating the Immigration Control Law up to 3 times) Deductions of up to 15 points are applied depending on the number of criminal proceedings due to violations of the Immigration Control Law.

Requirements for Employing Companies (Workplaces)

A. Basic Requirements: Workplaces currently employing at least one foreigner under the E-9, E-10, or H-2 skilled worker point system → Workplaces that currently employ foreigners who fall under any of the three residency qualifications (E-9, E-10, H-2).

B. Allowed Number: Within 30% of the current number of national employees at the workplace. – (Special Cases) For areas with declining populations and foundational industries, within 50% of the national employment number. – (Inclusion of foreigners with different qualifications) Foreign employees under E-7-4, E-7, E-9, E-10, H-2, F-2, F-4, F-5, and F-6 are excluded from the foreign employee count. ※ For the allowed number, decimal points are rounded up. For companies currently employing E-9 and E-10 foreign workers, a minimum of 1 person can be employed (2 persons for areas with declining populations and foundational industries).

C. Exclusions: Companies with unpaid taxes (national and local taxes) are excluded.

【 Skilled Worker Points System (E-7-4) : Evaluation Items 】

□ Eligible Applicants: Foreign employees who have worked legally in Korea for 5 years or more during the recent 10 year period on E-9, E-10, or H-2 Visa.

– Ineligibility: Criminals, tax delinquents, and those who have violated the Immigration Act more than 4 times.

☞ However, those who have cleared overdue taxes are eligible to apply.

□ Eligibility requirements: Persons who meet one of the points requirements below out of the total 209 points
1. Persons who obtained 52 points or more in total with at least 10 points earned in ‘Annual income’of the Industry contribution value factor.
2. Persons who obtained 72 points or more in total with at least 35 points earned in Future Contribution Value.

: Points in item Ⓐ are to be awarded for those who have studied at a Korean university for 2 years or more and earned an Associate degree or higher in Korea. Combination with the items of ‘Academic credentials’/‘Academic background’listed above is allowed (Regardless of majors in relation to the relevant field).

As to item Ⓑ, only recommendation letters from the relevant Ministry related to the field an applicant is working in on the date of application are to be accepted and the head of a relevant Ministry may make recommendations applying points differences within the range of maximum 10 points.

As to item Ⓒ, work experience in Eup/Myeon area should be at least 2 years (Metropolitan cities or above and Gyeonggi-do are excluded).

As to item Ⓓ, those (Decoration/Medal/Official commendation) awarded by the Government or local governments only are to be accepted (2 points each, maximum 5 points).

(Volunteer work) domestic social volunteer work for more than a year with at least 200 hours (Contribution to a local community of providing volunteering work for the public needs to be proven – at the discretion of the chief of immigration(branch) office) : Combination of the items  of official commendation and social volunteer work is NOT allowed. (Only one item to be counted in). Item Ⓔ means annual income tax payment record in the past one year from the date of application.
